Terms of Service

These Terms of Service ("Terms") form a binding agreement between SHATAK Infotech Pvt. Ltd. ("we", "us") and the organisation that creates an account on Byld360 (the "Service"). By accessing or using the Service, your organisation agrees to these Terms. If you are accepting on behalf of an organisation, you confirm you have authority to bind it.

Byld360 is a software-as-a-service platform that helps construction and infrastructure teams plan, record and reconcile site operations — work logs, materials, machinery, procurement, subcontracting and reporting.

The organisation that signs up owns the account and the data within it. Administrators control teammate access and may transfer or revoke ownership in line with internal policies.

• Provide accurate registration and billing information.
• Keep credentials confidential and use multi-factor protection where available.
• Use the Service in compliance with applicable laws and contractual obligations.
• Not impersonate another person or organisation.
• Pay applicable fees on time as per the chosen plan.

Misuse — including attempts to bypass security, scrape data, reverse engineer the Service, transmit malware, or interfere with other customers — is prohibited. See our Acceptable Use Policy for the full list.

We design the Service to keep working through patchy connectivity common on construction sites. Where possible, work-in-progress is preserved locally and synced when the network returns. Continuity features are best-effort; customers remain responsible for verifying that synced records reflect physical site reality.

We may suspend or terminate access for non-payment, breach of these Terms, abuse, or where required by law. We will give reasonable notice where practical. Customers may terminate at any time as described in the Refund Policy.

Subscriptions are billed monthly or annually in advance. Prices, plan features and seat limits are described at the point of purchase. Renewals are automatic unless cancelled before the renewal date.

Byld360, its source code, design, trademarks and all related materials are owned by SHATAK Infotech Pvt. Ltd.. Customer data remains the property of the customer. See the IP page for detail.

The Service is provided on an "as is" and "as available" basis. We disclaim implied warranties to the extent permitted by law. See the Disclaimer for scope.

To the maximum extent permitted by applicable law, neither party will be liable for indirect, incidental, special, consequential or punitive damages. Aggregate liability under these Terms will not exceed the fees paid by the customer for the twelve months preceding the claim.

Each party will indemnify the other against third-party claims arising from its own breach of these Terms, subject to prompt notice and reasonable cooperation in the defence.

Neither party will be liable for delays or failures caused by events beyond reasonable control, including natural disasters, labour actions, government orders, telecommunication failures or large-scale cloud outages.

These Terms are governed by the laws of India. Any dispute arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts at Kashipur, Uttarakhand, India.

The parties will first attempt to resolve disputes in good faith within thirty days of written notice. Unresolved disputes will be referred to arbitration under the Arbitration and Conciliation Act, 1996, seated in Kashipur, Uttarakhand, India.

We may update these Terms as the Service evolves. Material changes will be announced inside the product and reflected by the "last updated" date above. Continued use after the effective date constitutes acceptance.
